3. Purposes and Legal Bases of Processing

Your personal data are processed for the purpose of examining and responding to your request for access pursuant to Article 15 GDPR and in order to comply with the accountability obligation pursuant to Article 5(2) GDPR.

The legal bases are:

  • Art. 6(1)(c) GDPR in conjunction with Article 15 GDPR,

  • Art. 6(1)(e) GDPR in conjunction with Sections 3(1), 10 and 12 of the North Rhine-Westphalia Data Protection Act (DSG NRW).

4. Categories of Data Processed

  • Your contact details (e.g. address, email),

  • Information provided in your request,

  • Proof of identity (where required);

  • Communications relating to the processing of your request.

Within the LWL, your data are made available exclusively to the units responsible for processing your request for access. Disclosure to third parties will only take place insofar as this is necessary for processing your request, required by law, or based on your explicit consent.

6. Duration of Storage

The data processed in connection with your request for access will be stored for as long as is necessary to process the request and, where applicable, to document compliance with our legal obligations. Thereafter, the data will be deleted, blocked, or anonymized.

7. Obligation to Provide Data

Providing and storing your data is necessary in order to process your request for access. Without this information, your request cannot be handled.

8. Your rights as a data subject

Under the GDPR, you have in particular the following rights:

  • Access to your personal data (Article 15 GDPR),

  • Rectification of inaccurate data (Article 16 GDPR),

  • Erasure (Article 17 GDPR) or restriction of processing (Article 18 GDPR),

  • Objection to processing (Article 21 GDPR),

  • Data portability (Article 20 GDPR),

  • Lodging a complaint with a supervisory authority (Article 77 GDPR) – see Section 9.

Please note that these rights may be restricted by law in individual cases.

9. Right to Lodge a Complaint with a Supervisory Authority

Pursuant to Article 77 GDPR, you may lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement.
